Welcome to SM Luxe. These Terms of Service govern your use of our website at smluxe.shop and any purchases you make with us. By accessing our website or placing an order, you agree to be bound by these terms. Please read them carefully before proceeding.

SM Luxe is owned and operated from Pennsylvania, United States. References to "we", "us", "our" and "SM Luxe" throughout this document refer to SM Luxe. References to "you" and "your" refer to you, the customer.

1. ELIGIBILITY

By using our website and placing an order with us, you confirm that:

  • You are at least 18 years of age
  • You are a resident of the United States
  • You are legally capable of entering into a binding agreement
  • All information you provide to us is accurate, current and complete

We reserve the right to refuse service to anyone at our sole discretion.

2. OUR PRODUCTS

SM Luxe offers a curated collection of luxury women's fashion including dresses, matching sets, jumpsuits, tops, skirts, trousers, swimwear and loungewear. Every product in our collection is hand-selected to meet our standards of quality, elegance and style.

We make every effort to display our products as accurately as possible, including colours, textures and sizing. However, please note that colours may appear slightly different depending on your screen settings and device. Product descriptions are provided in good faith and are subject to change without notice.

We reserve the right to limit quantities, discontinue products or modify our collection at any time without prior notice.

3. ORDERS AND PAYMENT

When you place an order on smluxe.shop, you are making an offer to purchase. SM Luxe reserves the right to accept or decline any order at our discretion. Your order is not confirmed until you receive an order confirmation email from us.

By placing an order, you confirm that:

  • The payment information you provide is accurate and belongs to you
  • You are authorised to use the payment method provided
  • Your payment will be honoured by your card issuer or payment provider

We accept all major credit and debit cards as well as other payment methods available at checkout, all processed securely through Shopify's payment system.

All prices are listed in US Dollars (USD) and are inclusive of any applicable taxes unless otherwise stated. We reserve the right to adjust pricing at any time. The price charged will always be the price displayed at the time of your order.

4. SHIPPING AND DELIVERY

SM Luxe currently ships within the United States only. All orders are processed within 1–3 business days of payment confirmation. Estimated delivery time is 6–12 business days from the date of dispatch.

Please note that delivery timeframes are estimates only and are not guaranteed. Delays may occasionally occur due to factors outside of our control, including carrier delays or adverse weather conditions. SM Luxe is not liable for any such delays.

Once your order has been dispatched, you will receive a shipping confirmation email with your tracking number so you can monitor your delivery at all times.

Free shipping is offered on all US orders with no minimum spend required.

5. RETURNS AND REFUNDS

We want you to love every SM Luxe piece. If for any reason you are not completely satisfied, we offer a 7-day return policy from the date of delivery.

To be eligible for a return:

  • The item must be in its original condition — unworn, unwashed and with all tags attached
  • The item must be in its original packaging
  • You must contact us within 7 days of receiving your order at support@smluxe.shop

Please note that the customer is responsible for return shipping costs. Items returned without prior authorisation will not be accepted. Sale items are non-returnable.

Once your return has been received and inspected, we will notify you of the outcome. If approved, your refund will be processed to your original payment method within 3–5 business days.

For damaged, defective or incorrect items, please contact us within 48 hours of delivery with photographs and we will make it right immediately.

6. CANCELLATIONS AND AMENDMENTS

Orders can only be cancelled or amended within 24 hours of being placed. After this window, your order will have entered processing and we may be unable to make changes. Please contact us immediately at support@smluxe.shop if you need to cancel or amend your order.

7. INTELLECTUAL PROPERTY

All content on smluxe.shop — including but not limited to our logo, brand name, product descriptions, images, graphics, text and design — is the property of SM Luxe and is protected by applicable copyright and intellectual property laws.

You may not reproduce, copy, distribute, modify or use any of our content for commercial purposes without our prior written consent. Unauthorised use of SM Luxe's intellectual property is strictly prohibited.

8. CUSTOMER CONDUCT

By using our website, you agree not to:

  • Use our website for any unlawful or fraudulent purpose
  • Attempt to gain unauthorised access to our systems or data
  • Post or submit false, misleading or defamatory content
  • Infringe upon the intellectual property rights of SM Luxe or any third party
  • Engage in any conduct that disrupts or interferes with the operation of our website

We reserve the right to suspend or terminate access to our website for any user who violates these terms.

9. THIRD-PARTY SERVICES

SM Luxe is powered by Shopify and works with trusted third-party partners to operate our store and fulfil your orders, including Trendsi for fulfilment, Aftership for order tracking, Omnisend for email communications and others. While we carefully select our partners, SM Luxe is not responsible for the actions, content or privacy practices of any third-party service providers. Use of any third-party services is subject to their own terms and policies.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, SM Luxe shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of our website or products, including but not limited to loss of revenue, loss of data or loss of business opportunity.

Our total liability to you for any claim arising from your use of our website or purchase of our products shall not exceed the total amount paid by you for the order in question.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or any other liability that cannot be excluded by law.

11. DISCLAIMER OF WARRANTIES

Our website and products are provided on an "as is" and "as available" basis. SM Luxe makes no warranties or representations, express or implied, regarding the accuracy, reliability or completeness of any content on our website. We do not warrant that our website will be uninterrupted, error-free or free of viruses or other harmful components.
